Terms of Service

These Terms of Service ("Terms") govern access to and use of Job Helper (the "Service"), a private invite-only portal operated by Mayank Agarwal ("we", "us"). By accessing the Service you ("the User") agree to these Terms.

The Service is offered on an invite-only basis to individual candidates approved by the operator. Access is granted via Google Sign-In and is non-transferable. We may revoke access at our discretion at any time.

4. Email content responsibility

All emails sent by the Service originate from the User's own Gmail account and are attributable to the User as the legal sender. The User remains responsible for the content of those emails, including compliance with the CAN-SPAM Act (US), GDPR (EU/UK), DPDP Act (India), and any other applicable jurisdiction. The Service drafts emails using AI; the User is responsible for reviewing them as needed and may edit any draft before sending.

5. Third-party services

The Service relies on Google (Gmail API), Anthropic (Claude API) and Oracle Cloud Infrastructure to function. The User authorizes the Service to call these third parties on the User's behalf, within the scopes the User has granted. Each third-party service has its own terms; users should review them where relevant.

6. No warranty

The Service is provided "as is" and "as available", without warranty of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any specific outcome (a job interview, an offer, etc.) will result from its use. AI-generated content may contain factual errors; the User is solely responsible for the final content of any email sent.

7. Limitation of liability

To the maximum extent permitted by law, in no event will the operator be liable for any indirect, incidental, special, consequential or punitive damages — including lost employment opportunities, lost profits, lost reputation, or data loss — arising out of or related to the Service. Aggregate liability for any claim arising under these Terms is capped at INR 1,000 or the amount the User has paid for the Service in the preceding 12 months, whichever is greater.

8. Indemnity

The User agrees to indemnify and hold harmless the operator from any claim arising out of the User's use of the Service, including content the User caused to be sent through the Service.

9. Termination

Either party may terminate access to the Service at any time, for any reason, with or without notice. On termination, Sections 4 (Email content responsibility), 6 (No warranty), 7 (Limitation of liability) and 8 (Indemnity) survive.

10. Governing law

These Terms are governed by the laws of India. Disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of New Delhi, India.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted here and notified to active Users by email. Continued use of the Service after a change constitutes acceptance of the revised Terms.
